Ever since Maryland recognized same-sex marriage, lesbian and gay couples have been treated the same as everyone else under Maryland’s divorce laws. You must meet the same residency requirements: If the grounds for divorce occurred in Maryland, at least one spouse must currently live in Maryland, and if the grounds for divorce occurred out of state, at least one spouse must have been living in state for at least the past12 months. Gay divorce in state resolves the same legal issues, such as distribution of marital property, spousal support, child support, child custody and visitation.

Maryland law does not, however, govern the distribution of federal employee benefits, such as pensions and retirement accounts. Until the federal government fully recognizes gay marriage, the distribution of marital assets in a divorce will be complicated when one or both of the spouses are employees or retirees of the federal government.
